We treat non-public information shared with us in the course of a project as confidential and use it only to deliver the agreed services. We expect the same commitment from our clients regarding non-public information we share with them. Confidentiality obligations for a specific engagement may be defined further in the applicable agreement.

9. Intellectual Property and Ownership

Unless otherwise agreed in writing, clients receive ownership of the final deliverables produced specifically for them upon full payment, along with a full handover. We retain ownership of our pre-existing tools, frameworks, and general know-how. Third-party components remain subject to their respective licenses. Our work often relies on third-party services such as cloud providers, payment gateways, and external APIs. We select reputable providers, but we are not responsible for outages, pricing changes, or policy changes originating from those providers.

4. Client Responsibilities

The client is responsible for:

  • Providing required third-party API credentials
  • Informing us of significant application changes
  • Following applicable laws and regulations
  • Maintaining ownership of their business data and intellectual property

The client must not intentionally use the hosting environment for illegal, fraudulent, abusive, malicious, or unauthorized activities.

5. Application Ownership

Unless otherwise agreed in writing, the client retains ownership of:

  • Application-specific business data
  • Client-provided content
  • Client-owned intellectual property
  • Client-specific branding and assets

Hosting the application on our infrastructure does not transfer ownership of the client's application or business data to us.

Our hosting service provides infrastructure and management services only.

6. Data Protection and Security

We take reasonable technical and organizational measures to protect hosted applications and data.

Depending on the project, security measures may include:

  • Restricted server access

Where backups are provided, backup frequency, retention period, storage location, and restoration procedures may vary depending on the selected plan.

8. Availability

We aim to maintain high availability for applications hosted on our infrastructure.

However, we do not guarantee uninterrupted availability unless a specific uptime commitment or Service Level Agreement (SLA) has been agreed upon in writing.

Additional infrastructure or development costs may apply when scaling beyond the resources included in the client's hosting plan.

12. Deployment and Maintenance

We may deploy application updates, bug fixes, security patches, and infrastructure changes as required to maintain the application.

For major changes that may affect application functionality or availability, we will make reasonable efforts to notify the client in advance.

Emergency changes may be performed without prior approval when necessary to protect the infrastructure, application, or client data.

13. Support

Managed hosting includes support for infrastructure and deployment-related issues within the scope of the selected hosting plan.

Support does not automatically include unlimited application development or feature development.

Requests such as:

  • New features
  • Major UI changes
  • New integrations
  • Business logic changes
  • Major database restructuring
  • Significant application modifications

may be treated as separate development work and may incur additional charges.

14. Hosting Fees

Managed hosting fees are determined based on the infrastructure and services required by the project.

Hosting fees may include:

  • Server infrastructure
  • Storage
  • Bandwidth
  • Monitoring
  • Backups where applicable
  • Maintenance
  • Deployment support
  • Infrastructure management

Additional costs may apply if the application's resource requirements exceed the original hosting plan.

Any applicable pricing and renewal terms will be communicated to the client before service commencement.

15. Non-Payment and Suspension

If hosting fees remain unpaid after the applicable payment period or grace period, we may temporarily suspend the hosted application or associated services.

Where reasonably possible, the client will receive prior notification before suspension.

We will not intentionally delete client data immediately upon suspension. However, data retention after termination or prolonged non-payment is subject to the applicable hosting agreement and backup retention policy.

16. Prohibited Activities

Our infrastructure must not be used for:

  • Illegal activities
  • Malware distribution
  • Phishing
  • Spam or unauthorized bulk messaging
  • Unauthorized access to systems
  • Cryptocurrency mining without written authorization
  • Copyright infringement
  • Distribution of unauthorized or illegal content
  • Activities that intentionally disrupt infrastructure
  • Activities that violate applicable laws or third-party provider policies

We reserve the right to suspend services where necessary to protect our infrastructure, other clients, or the public.

17. Migration and Termination

Clients may choose to discontinue our managed hosting service subject to the terms of their service agreement.

Upon termination, we can provide reasonable assistance with migration where agreed.

Migration assistance may include:

  • Application source code handover where applicable
  • Database export
  • Configuration documentation
  • Deployment documentation
  • DNS transition assistance

Additional migration or technical assistance fees may apply depending on the complexity of the migration.

18. Infrastructure Changes

We reserve the right to change the underlying infrastructure provider, server configuration, hosting technology, or architecture when reasonably necessary to improve:

  • Scalability
  • Cost efficiency
  • Infrastructure availability

Such changes should not materially reduce the functionality of the client's application.

19. Service Responsibility

Our responsibility is to provide and maintain the hosting environment according to the services included in the client's hosting plan or agreement.

We are not responsible for application problems caused by:

  • Client modifications
  • Unauthorized third-party modifications
  • Incorrect credentials
  • Third-party API failures
  • Client-provided code
  • DNS misconfiguration controlled by the client
  • External services
  • Changes made outside our managed environment

Where an issue is caused by application code developed by us, we will investigate and address it according to the applicable development/support agreement.

20. Transparency and Client Data

Clients may request information regarding their hosted application, infrastructure configuration, backups, and migration requirements, subject to reasonable security restrictions.

We do not claim ownership of client business data solely because the data is stored or processed within infrastructure managed by us.

We may update this policy from time to time to reflect changes in our infrastructure, services, security practices, or applicable requirements.
